Fathers’ Rights

Divorce and custody cases can make people feel alone. With our lawyers’ help, however, you will not go through this alone. We will fight as hard as necessary to protect your rights.

Do You Know Your Rights as a Nebraska Father?

In family law cases, it is often assumed that the mother is entitled to preferential treatment when it comes to children. In the past several years, however, courts have taken a stronger stance about giving fathers their due rights, pushing harder for equality between fathers and mothers. Whether a couple is divorcing or has never been married, it is important that the best interests of the children always be at the forefront of the case.

Our family law attorneys at Monzón, Guerra & Chipman, Attorneys At Law, in Lincoln, Nebraska, are also dedicated to helping fathers exercise their rights, ensuring that parenting time and child support are appropriately arranged.

DNA Testing

Before child custody and child support orders can be created, the proper father must be established. Paternity can be determined through a DNA test. With advances in technology, a simple swab from the inside of the potential father’s cheek and the inside of the child’s cheek can be analyzed, and parentage can be confirmed.

Once DNA analysis has been completed and the child’s father has been determined, the court can then decide how child custody will be split between the parents and how the state child support guidelines will be applied in the case.
