Sexual Assault Penalties

Similar to most states, Nebraska classifies sexual assault by degrees based on the severity of the allegations and other relevant details of the alleged crime. First-degree sexual assault, also known as rape, is defined as subjecting another to sexual penetration (1) without the victim's consent, (2) when the perpetrator knew or should've known that the victim was mentally or physically unable to resist or appraise the nature of their conduct, or (3) when the suspect is 19 or older, and the victim is at least 12 but younger than 16. First-degree sexual assault is a Class II felony, which is punishable by a prison sentence between one and 50 years.

Second-degree sexual assault is defined as subjecting another to sexual contact (1) without the victim's consent or (2) when the perpetrator knew or should've known that the victim was mentally or physically unable to resist or appraise the nature of their conduct. Second-degree sexual assault is a Class III felony, which is punishable by a prison sentence between one and 20 years and/or a fine of up to $25,000.

Third-degree sexual assault is a Class I misdemeanor, which is punishable by a maximum jail sentence of one year and/or a fine of up to $1,000. The difference between a third-degree sexual assault charge and a second-degree sexual assault charge is whether sexual contact resulted in serious bodily injury.
