Drug Possession Penalties

Nebraska divides controlled dangerous substances (CDS) into five “schedules.” Schedule I consists of the most dangerous drugs regarding potential for addiction and abuse. Subsequent schedules decrease in dangerousness and risk of abuse as well as increase in medical value. Possession of CDS and substances used for manufacturing purposes is considered a Class IV felony, which is punishable by a maximum five-year prison sentence and a fine of up to $10,000.

However, possession of 1 ounce or less of marijuana is considered an infraction, punishable by a maximum fine of up to $300.
